In Sabang City, Aceh, this concept is still practiced children whose parents die before the inheritance giver are considered ineligible to receive inheritance. This stems from the belief that such children are not specifically mentioned in the Qur’anic inheritance divisions, and thus, do not qualify to inherit from their grandparents. This study aims to explore the concept of patah titi in Sabang society and analyze it through Article 185 of the Compilation of Islamic Law (KHI) regarding substitute heirs. The research uses an empirical legal approach combined with statutory analysis. Findings show that the patah titi practice remains active in Gampong Kuta Timu, Sabang, despite existing legal provisions on substitute heirs in the KHI. Misunderstanding the meaning of patah titi has created more negative than positive impacts not only in the inheritance process but also in weakening family bonds. In practice, grandchildren affected by patah titi may receive assets through grants, whereas grandchildren recognized as substitute heirs receive assets through inheritance.
Aulil Amri, Arifin Abdullah, Nur Muhajirah Siagian, Faisal Yahya, Nurul Fithria ##submission.copyrightStatement## https://journal.uinsi.ac.id/index.php/qonun/article/view/12689 Thu, 09 Apr 2026 15:37:22 +0800 Fikih Jinayah dan Relevansinya Terhadap Hukum Keluarga https://journal.uinsi.ac.id/index.php/qonun/article/view/12697
Marina Yetrin Sriyati Mewu, AAA. In Indonesia, fatwas issued by the National Sharia Council of the Indonesian Ulama Council (DSN-MUI) play a crucial role in establishing the normative framework of Islamic economic practices. This study aims to examine the use of necessity-based legal maxims (qawāʿid al-ḍarūra) in DSN-MUI fatwas and to analyze their methodological implications for the development of contemporary Islamic economic jurisprudence. Employing a qualitative approach with documentary analysis and content analysis methods, this research analyzes 165 DSN-MUI fatwas issued during the early phase of Islamic economic development in Indonesia. The findings reveal that 89 fatwas, representing approximately 53.9% of the total sample, explicitly employ legal maxims related to necessity, harm removal, or urgent need as the basis of legal reasoning. The most frequently applied maxims include al-ḍarar yuzāl, al-ḍarar yudfaʿ bi-qadr al-imkān, and al-ḥājah tanzil manzilat al-ḍarūra. These maxims are predominantly applied within sectors characterized by high transactional complexity, particularly Islamic banking, Islamic capital markets, and modern financial industries. The findings indicate that necessity-based maxims no longer function solely as exceptional mechanisms in classical Islamic jurisprudence but have evolved into methodological tools for adapting Islamic law to the dynamics of modern economic systems. This study contributes to the theoretical discourse on Islamic legal methodology by highlighting the strategic role of qawāʿid fiqhiyyah in the evolution of contemporary fiqh al-muʿāmalāt
Ahmad Musadad, Shofiyun Nahidloh, Baihaqi Baihaqi, Misno Misno, A Mufti Khazin, Tri Pujiati ##submission.copyrightStatement## https://journal.uinsi.ac.id/index.php/qonun/article/view/12822 Fri, 17 Apr 2026 16:38:51 +0800 Sad Al-Dzara'i As a Preventive Norm in Family Law a Conceptual Analysis and Practical Application https://journal.uinsi.ac.id/index.php/qonun/article/view/12738
This study examines sad al-dzara’i as a preventive normative principle in Islamic family law in response to contemporary socio-legal challenges. While existing scholarship predominantly emphasizes maqasid al-shari’ah as a framework for reform, limited attention has been devoted to the systematic operationalization of sad al-dzara’i as a structured preventive mechanism. This study addresses that gap by reconstructing its epistemological foundation and analysing its practical relevance in Indonesian family law contexts. Employing normative legal research with conceptual and statutory approaches, this article analyses classical ushul al-fiqh literature alongside Indonesian family law regulations. It further incorporates contextual socio-legal analysis of Aceh and Probolinggo, selected for their contrasting legal configurations: Aceh with formal Sharia-based regional regulations and Probolinggo within the national legal framework shaped by strong socio-religious authority. The findings indicate that sad al-dzara’i functions not merely as a theoretical doctrine but as an operational preventive paradigm reflected in regulatory safeguards, marriage age restrictions, and mediation mechanisms aimed at mitigating risks such as child marriage and family instability. The study concludes that integrating sad al-dzara’i within contemporary family law strengthens its anticipatory and adaptive character, aligning with maqasid al-shari’ah in safeguarding life, dignity, intellect, and lineage, while offering a preventive legal model for plural legal systems.
Muhammad Zainuddin Sunarto, Ahmad Idhafi ##submission.copyrightStatement## https://journal.uinsi.ac.id/index.php/qonun/article/view/12738 Mon, 20 Apr 2026 12:47:32 +0800 Fiqh Al-Muwazanah as a Governance Oriented Framework for Digitally Mediated Marriege in Islamic Family Law https://journal.uinsi.ac.id/index.php/qonun/article/view/12742
There is a literature exploring how these digitally mediated marriages are managed within a governance framework to mitigate long-term legal and social risks. No studies have specifically utilized the instrument of Fiqh Al-Muwazanah as an ethical and managerial basis for ensuring legal certainty in a digital ecosystem vulnerable to identity manipulation and technical failures. This fiqh al-muwāzanah, the jurisprudence of balancing benefits (maṣlaḥah) and harms (mafsadah), as a governance-oriented risk-assessment framework for digitally mediated marriage practices. Employing a conceptual approach statute approach method with a maqāṣid-oriented doctrinal approach, the study critically reinterprets ittiḥād al-majlis by shifting its emphasis from physical co-presence to legal continuity and procedural certainty. The analysis demonstrates that digital presence may conditionally satisfy the objectives of ittiḥād al-majlis where real-time interaction, verifiable identity, reliable witnessing, and safeguards against coercion are effectively ensured. However, such accommodation is framed as exceptional rather than normative, particularly considering risks affecting consent, evidentiary reliability, and the protection of vulnerable parties. Beyond the specific issue of online marriage, this study contributes to contemporary Islamic legal theory by demonstrating how fiqh al-muwāzanah can function as a structured mode of legal reasoning capable of governing technological change within legally plural systems. novelty by reconstructing the role of Fiqh Al-Muwazanah not merely as an abstract legal theory, but as an operational (governance-oriented) framework for digitally mediated marriages. Unlike conventional approaches, this paper proposes new parameters in Islamic family law that balance technological convenience (taysir) with the protection of the purposes of marriage (maqasid al-nikah) through digital risk mapping.
Helmi Basri, Mukhlis Lubis ##submission.copyrightStatement## https://journal.uinsi.ac.id/index.php/qonun/article/view/12742 Thu, 23 Apr 2026 07:51:48 +0800 Reassessing Online Dispute Resolution Frameworks in Indonesia, Malaysia, and the Philippines https://journal.uinsi.ac.id/index.php/qonun/article/view/12705
This study examines the legal vacuum surrounding cross-platform online dispute resolution (ODR) within Southeast Asian online marketplace ecosystems, particularly where disputes arise from transactions involving integrated third-party services. The objective of this research is to assess the adequacy and consistency of legal frameworks in Indonesia, Malaysia, and the Philippines in accommodating cross-platform ODR. This study employs the doctrinal legal research method and the comparative approach for a deep dive statutory analysis and descriptive examination of primary legal sources across different legal systems. The findings demonstrate that while all three jurisdictions recognize electronic transactions and alternative dispute resolution in principle, none provides comprehensive regulation for cross-platform ODR. Indonesia explicitly acknowledges ODR in its e-commerce regulation but exhibits normative disharmony with its ADR framework. Malaysia’s arbitration and mediation regimes remain structurally unsuitable for low-value, high-volume marketplace disputes. The Philippines introduces a centralized ODR mechanism yet fails to address liability allocation in integrated multi-platform transactions. The legal vacuum identified necessitates an integrated ODR framework capable of ensuring procedural coherence, data coordination, and enforceability. Findings of this study contribute to the effort to understand the implications dispute resolutions in today’s digital economy by highlighting practical implications for scholars and policymakers alike.
Tantimin Tantimin, Michael T. In this context, Indonesia's Plant Variety Protection (PVP) Law represents an IPR regime that can be analyzed further to explore the potential of helping Indonesia tackle climate change. This research analyzes the legal capacity of Indonesia’s PVP regime to integrate climate action initiatives, which provides a novel perspective by bridging intellectual property rights and sustainability, with the added comparative angle of Singaporean perspective. The findings of this research indicate that Indonesia's PVP regime is outdated and ill-equipped to accommodate the regime’s inherent potential in being a part of the climate action. In contrast, Singapore boasts a more robust legal framework that has facilitated the growth of its modern agricultural sector, despite resource constraints, along with the lack of direct normative connection between sustainability and the PVP regime, due to supporting normative architectures. The perspective from Singapore represents a potential model for Indonesia to consider as it seeks to enhance its PVP regime and align it with broader climate change mitigation strategies.
Muhammad Amirul Hasbi, Akbarizan Akbarizan, Hendri Sayuti ##submission.copyrightStatement## https://journal.uinsi.ac.id/index.php/qonun/article/view/12759 Mon, 27 Apr 2026 12:38:52 +0800 The Tradition of “Uang Hantaran” in Riau Malay Marriage: an ‘Urf-Based and Maqāṣid Al-Sharī‘ah Analysis https://journal.uinsi.ac.id/index.php/qonun/article/view/13137
This study examines the tradition of uang hantaran in Riau Malay marriages from the perspective of Islamic law, addressing the limited analytical discussion on its legal status and socio-religious implications. Using a qualitative ethnographic approach, data were collected through fieldwork in Siak Regency, Pekanbaru City, and Dumai City, involving interviews with community members and religious figures. The findings show that uang hantaran is a deeply rooted customary practice determined through mutual agreement, functioning as both financial support for wedding expenses and a symbol of commitment. However, excessive demands may generate financial burdens, indebtedness, and delays in marriage. From the standpoint of Islamic jurisprudence, although not prescribed in the Qur’an or Sunnah, the practice may be accommodated under the concept of ‘urf (custom) as long as it aligns with Islamic principles—permissible when it promotes maṣlaḥah and invalid when it leads to mafsadah. This study contributes by offering an integrative ‘urf-based analysis that bridges local cultural practices with Islamic legal theory, providing a more nuanced framework for evaluating customary marriage traditions in contemporary Muslim societies.
Mawardi Mawardi, Masduki Masduki, Khairil Anwar, Firman Surya Putra, Azzuhri Al-Bajuri, Agusman Saputra ##submission.copyrightStatement## https://journal.uinsi.ac.id/index.php/qonun/article/view/13137 Mon, 11 May 2026 16:31:56 +0800
