Waqf and Its Implementation in Islamic Education: A Comparative Study of Educational Waqf in Indonesia and Thailand from the Perspective of Islamic Law
Abstract
Penelitian ini bertujuan untuk menganalisis implementasi wakaf di bidang pendidikan dalam perspektif hukum Islam dengan studi komparatif antara Indonesia dan Thailand. Wakaf, sebagai salah satu instrumen filantropi dalam Islam, memiliki peran penting dalam mendukung pembangunan sosial dan ekonomi, khususnya dalam sektor pendidikan. Penelitian ini menggunakan pendekatan kualitatif dengan metode studi kepustakaan, serta analisis terhadap regulasi dan praktik wakaf di kedua negara. Hasil penelitian menunjukkan bahwa meskipun terdapat perbedaan kontekstual antara Indonesia dan Thailand dalam pengelolaan wakaf, keduanya memanfaatkan wakaf pendidikan untuk memperkuat akses terhadap pendidikan bagi masyarakat Muslim. Di Indonesia, wakaf pendidikan telah berkembang melalui dukungan pemerintah dan regulasi yang mengatur pemanfaatan serta pengelolaan harta wakaf. Sementara itu, di Thailand, pengelolaan wakaf pendidikan dilakukan dengan pendekatan komunitas yang lebih informal, menyesuaikan dengan kondisi minoritas Muslim di negara tersebut. Studi ini menyimpulkan bahwa dengan optimalisasi wakaf pendidikan, kedua negara memiliki potensi besar dalam meningkatkan kualitas pendidikan umat Islam. Implikasi dari penelitian ini diharapkan dapat memberikan masukan bagi pengembangan kebijakan wakaf yang lebih efektif dan berkelanjutan di sektor pendidikan, serta memperkaya literatur terkait wakaf dalam perspektif hukum Islam.
