Copyright and Licensing Policy

1. General Policy

The Borneo Journal of Language and Education (BENJOLE) is committed to protecting authors' intellectual property rights while promoting the broad dissemination and responsible reuse of scholarly research.

BENJOLE adopts a copyright and licensing framework that supports open access, author rights, transparent attribution, and the lawful reuse of published work. This policy applies to manuscripts accepted for publication and articles published by the journal.

Authors are responsible for ensuring that submitted materials are original, that third-party materials are appropriately acknowledged, and that any required permissions have been obtained before publication.

2. Copyright Ownership

Authors retain the copyright to their published work in BENJOLE.

By publishing with the journal, authors grant BENJOLE the right of first publication and authorize the journal to publish, distribute, preserve, and make the article available through its official publishing platform and other appropriate dissemination channels.

Copyright retention does not prevent BENJOLE from publishing and distributing the work under the applicable license.

Authors remain responsible for ensuring that they have the necessary rights to submit and publish their work, including any material created by other individuals or organizations.

3. Creative Commons License

Articles published in BENJOLE are distributed under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

The license permits users to:

  • Share, copy, and redistribute the material in any medium or format.
  • Adapt, remix, transform, and build upon the material.
  • Use the material for commercial or non-commercial purposes.

These permissions apply provided that users comply with the license terms.

Users must provide appropriate attribution to the original author or authors, identify the original publication in BENJOLE, provide a link to the CC BY 4.0 license, and indicate whether changes have been made.

Users must not imply that the authors or BENJOLE endorse a particular use or adaptation without appropriate authorization.

The license does not automatically grant rights to third-party materials included in an article when those materials are subject to separate copyright or licensing restrictions.

The full license is available at: https://creativecommons.org/licenses/by/4.0/

4. Rights and Responsibilities of Authors

Authors retain the right to use and disseminate their published work in accordance with the applicable copyright and licensing terms.

Authors may:

  • Share the published article through personal websites and academic platforms.
  • Deposit the published version in institutional or subject repositories.
  • Distribute copies for academic, educational, and research purposes.
  • Reuse their work in books, teaching materials, academic presentations, and subsequent scholarly publications.
  • Adapt or develop their published work for further research, subject to appropriate attribution and the applicable license terms.

Authors should acknowledge BENJOLE as the original place of publication and provide the official article URL or DOI where available.

Authors must ensure that subsequent uses do not misrepresent the original findings, authorship, or publication history.

5. Preprints and Online Dissemination

BENJOLE permits and encourages authors to share their work through preprint servers, institutional repositories, personal websites, and other appropriate online platforms before and during the submission process.

Such dissemination is intended to encourage scholarly exchange, improve research visibility, and facilitate academic collaboration.

Authors must ensure that preprint sharing does not violate third-party rights, confidentiality obligations, or applicable research ethics requirements.

When a version of the work has been published in BENJOLE, authors are encouraged to update the relevant record with the final publication details and link to the published article.

Preprint availability does not exempt a manuscript from the journal's originality requirements, exclusive-submission policy, or peer-review process.

6. Third-Party Materials and Permissions

Authors are responsible for obtaining permission to reproduce or adapt copyrighted materials when permission is required.

Third-party materials may include:

  • Figures, photographs, illustrations, and diagrams.
  • Tables and substantial extracts from published works.
  • Instruments, questionnaires, or other protected research materials.
  • Audio, video, and other multimedia content.
  • Other materials subject to copyright or licensing restrictions.

Authors must provide appropriate attribution and acknowledge the source of third-party materials. Where necessary, evidence of permission must be supplied to the editorial team before publication.

Materials used under an applicable open license must comply with the conditions of that license.

Authors should not assume that all materials included in an open-access article are automatically available for unrestricted reuse under CC BY 4.0. Any separate rights notices or restrictions attached to third-party materials must be respected.

7. Copyright Infringement and Intellectual Property Concerns

BENJOLE expects all authors to respect copyright, intellectual property rights, privacy rights, and other applicable legal requirements.

If a concern arises regarding unauthorized use of protected material, the editorial team may request clarification, supporting documentation, or evidence of permission from the authors.

Depending on the circumstances, the journal may request corrections, require the replacement or removal of material, suspend publication, or take other appropriate editorial action.

If an infringement concern arises after publication, BENJOLE will assess the available evidence and determine an appropriate response in accordance with its publication ethics and correction policies.

Serious concerns that affect the integrity of a published article may be handled under the journal's Correction and Retraction Policy.

8. Licensing and Reuse by Readers

Readers may reuse BENJOLE articles in accordance with the CC BY 4.0 license.

When reusing an article or a substantial portion of its content, users should provide appropriate attribution that includes, where available:

  • The author or authors.
  • The title of the article.
  • The journal name, BENJOLE.
  • The year of publication.
  • The DOI or official article URL.
  • A link to the CC BY 4.0 license.
  • An indication of whether changes or adaptations were made.

Users must not misrepresent the original work, imply endorsement by the authors or journal, or remove attribution in a way that violates the license.

Attribution requirements apply to both commercial and non-commercial reuse.

9. Relationship with Open Access

BENJOLE provides immediate open access to its published articles in accordance with its Open Access Policy.

Open access means that readers can access the published content without subscription or payment for access. Copyright ownership and licensing determine the rights and conditions under which that content may be reused.

Accordingly, free access to an article does not eliminate the need to comply with its license, provide appropriate attribution, or respect separate rights attached to third-party materials.

Further information is available on BENJOLE's Open Access Policy page.

10. Publication Fees and Copyright

Copyright retention and the CC BY 4.0 license are separate from any submission or publication fees that may apply.

Any author fees or article processing charges are governed by BENJOLE's Author Fees and Article Processing Charges policy.

Payment of publication-related fees does not transfer copyright ownership to the journal and does not alter the rights granted under the applicable license, unless a separate lawful agreement explicitly provides otherwise.

11. Digital Preservation and Long-Term Access

BENJOLE seeks to preserve its published articles and maintain their accessibility through the journal's online platform and archives.

Authors' copyright ownership and the applicable license remain in effect when articles are archived, preserved, or disseminated through authorized repositories and platforms.

Further information about the journal's preservation and archiving arrangements is provided in its Archiving Policy.

12. Policy Implementation

Authors, readers, and other users are expected to comply with this policy and the terms of the applicable Creative Commons license.

BENJOLE reserves the right to address suspected copyright violations and other intellectual property concerns in accordance with its editorial policies and applicable legal requirements.

The journal may revise this policy when necessary to reflect changes in scholarly publishing practices, licensing requirements, or applicable law. Any substantive changes will be communicated through the official journal website.
